Mgrm Position Paper On Marriage Equality

The Malta Gay Rights Movement has been advocating for the legal recognition of same-sex couples and their families since its inception in 2001 and while we have always believed that this was a just and important cause for the LGBT community, we knew it would be a long and difficult struggle.

Over the past ten years we have worked hard to raise awareness of homophobic and transphobic prejudices that affect the daily lives of our community making it harder to feel safe in coming out and expressing simple gestures of affection towards our loved ones. We have kept our parental ties with our children secret to protect them from harassment and bullying, been discreet about our identities to avoid distress to our parents and exercised caution at the workplace or school for fear of harassment or discrimination.

We have been excluded from public policy definitions of family and have observed in disbelief as our constitutional court refused a trans woman the right to marry. Those of us with partners from third countries have had to live with the stress of knowing that their partner’s visa might be refused and that they might be forced to emigrate in order to stay together.

The introduction of divorce legislation and the announcement by government of its intention to introduce cohabitation legislation has possibly brought forward this campaign.  As a movement we have always expressed our dissatisfaction with a potential cohabitation law that failed to recognise same-sex couples not on the basis of living in the same household but because of their relationship to each other.

The position paper which Dr Falzon will explain shortly is our attempt to put forward our belief that marriage equality is the only option that provides the same status and rights available to opposite sex couples and their children. Moreover it is the simplest form of recognition to introduce requiring minor adjustments to our legal framework.

We hope that the paper will give rise to a reasoned and much needed debate that is respectful of our relationships and the families we create and that is based on secular and human rights rather than religious discourse.

The discrimination experienced by same-sex couples is no longer tenable in today’s world and we will not cease our efforts until our goal has been achieved whether this takes months, years or even decades.

In a recent speech delivered by Hilary Clinton in Geneva she mentioned that leadership by definition implies at times being ahead of the people. Excuses based on society not being ready for the introduction of marriage equality therefore hold no sway. No harm ensues to society from the granting of equal rights to same-sex couples and therefore any delay cannot be morally justified. On the contrary, there are significant benefits to same-sex couples and their children as well as such legislation sending a clear message that discrimination on the bases of sexual orientation should never be condoned. Equality is not a luxury it is a basic human right and the time for it is now.

Matul l-aħħar għaxar snin ħdimna ħafna biex inqajmu kuxjenza dwar preġudizzji omofobiċi u transfobiċi li jaffettwaw il-ħajja ta 'kuljum tal-komunità tagħna u li jagħmilha aktar diffiċli li nħossuna sikuri fil coming out u li nesprimu ġesti sempliċi ta' affezzjoni lejn il-maħbubin tagħna. Zammejna r-rabtiet tagħna ta ġenituri mat-tfal tagħna sigrieta biex nħarsuhom mill-fastidju u l-ibbulijar; kollna diskreti dwar l-identitajiet tagħna biex nevitaw dieqa lill-ġenituri tagħna u eżerċitajna ‘l prudenza fil-post tax-xogħol jew l-iskola minħabba l-biża ta 'fastidju jew diskriminazzjoni.

Gejna esklużi mid-definizzjonijiet tal-familja u ma stajniex nemmnu meta l-qorti kostituzzjonali rrifjutat id-dritt taz-żwieġ lil mara trans. Dawk minna f’relazzjoni ma 'msieħba minn pajjiżi terzi kellhom jgħixu fil-biża li l-viża tas-sieħeb jew sieħba tagħhom tista tiġi rrifjutata u li jkunu kostretti li jemigraw sabiex jibqgħu flimkien.

L-introduzzjoni tal-leġiżlazzjoni tad-divorzju u t-tħabbir mill-gvern ta l-intenzjoni tiegħu li jintroduċi ligi tal-koabitazzjoni possibbilment ressqet il-quddiem din il-kampanja. Bħala moviment dejjem esprimejna n-nuqqas ta 'sodisfazzjon tagħna ma' liġi tal-koabitazzjoni li tonqos milli tirrikonoxxi koppji ta l-istess sess mhux fuq il-bażi li jgħixu fl-istess dar, imma minħabba r-relazzjoni ta bejniethom.

Il-position paper li Dr Falzon se jispjega dalwaqt hija tentattiv biex nesprimu t-twemmin tagħna li l-ugwaljanza fiz-żwieġ hija l-unika għażla li tipprovdi l-istess status u drittijiet ta’ dawk li jgawdu koppji tas-sess oppost  u t-tfal tagħhom. Barra minn hekk hija il-forma ta rikonoxximent li tirrekjed l-anqas aġġustament lill-qafas legali tagħna.

Nittamaw li dan id-dokument jagħti lok għal dibattitu raġunat u tant meħtieġa li jirrispetta ir-relazzjonijiet tagħna u l-familji li noħolqu u li jkun bbażat fuq  diskors sekulari u ffukat fuq id-drittijiet tal-bniedem u mhux diskors reliġjuż.

Id-diskriminazzjoni li jgħaddu minnha koppju ta l-istess sess m'għadhiex aktar tenibbli fid-dinja tal-lum u aħna mhux se nwaqqful-isforzi tagħna sakemm l-għan tagħna jinkiseb sew jekk dan jieħu xhur, snin jew anke għexieren ta 'snin.

F'diskors reċenti mogħti minn Hilary Clinton f'Ġinevra hija semmiet li t-tmexxija mid-definizzjoni taggha timplika li xi drabi trid timxi quddiem il-poplu. Skużi bbażati fuq li s-soċjetà mhijiex lesta għall-introduzzjoni tal-ugwaljanza fiz-żwieġ għalhekk mhumiex gustifikati. Ebda ħsara ma ssir fuq is-soċjetà mill-għoti ta 'drittijiet ugwali lill-koppji ta l-istess sess u għalhekk kull dewmien ma jistax ikun moralment ġustifikat. Għall-kuntrarju, hemm benefiċċji sinifikanti għall-koppji ta l-istess sess u t-tfal tagħhom filwaqt li leġiżlazzjoni bhal din tibgħat messaġġ ċar li d-diskriminazzjoni fuq il-bażi ta 'orjentazzjoni sesswali qatt ma għandha tiġi aċċettata. L-ugwaljanza mhix lussu imma dritt bażiku tal-bniedem u ż-żmien għall-ugwaljanza huwa issa.
